Myself and my defendant (then alive) were declared class 2 legal heirs via court judgement and decree. My defendant died. I filed a succession case in which I made the children of my deceased defendant a party. The children of my deceased defendant have never filed any document to prove that they are the legal heirs of my deceased defendant. In my SUCCESSION petition I mentioned that the 3 respondents are the legal heirs of my deceased defendant. I have only asked for my half share in succession as a relief in my prayer. I wish that my prayer be allowed and that the 3 respondents or the children of my deceased defendant should file a declaration case to prove themselves as legal heirs of their deceased mother.

My defendants in my SUCCESSION case have filed a separate case on me to declare my previous Judgements and decrees as null, void, fraud and illegal. At the same time they are aiming at getting half the share in succession case. I have only asked for my half share in my prayer in the succession case. The defendants have given an authority to a GPA and SPA who has given a false statement that it is my "dava" that the defendants be given half the share in succession case. It has been one and a half year and the defendants in their case of declaration have never brought any evidence. What can be done?

I have asked for my half share in in my SUCCESSION case as a petitioner. I have mentioned in my objections to defendants that they should file a counterclaim or a claim if they are to get their half share. Am I wrong in stating so? I was declared a legal heir along with my deceased defendant. Current defendants are her children who have not filed any proof of legal heirship. So I told them in my Objections that they should file a separate suit to get their half share in succession. Is it right?

I filed a succession case being a class 2 legal heir. My defendant died. I made the 3 children of my defendant a party to SUCCESSION case. In my prayer, I only asked for my half share in movable assets. Now my case was in arguments stage. I argued that the 3 defendants never filed a claim or a counter claim, at the written statement stage. They never filed any proof of being the legal heirs of my deceased defendant. The opposite councel came and argued that the 3 defendants are the children of my deceased defendant and that they should be given half the share in succession case. I argued that if I have made someone a party to my case, it does not mean that I am offering them half the share of movable assets in succession. And that the 3 defendants have never filed any proof of them being legal heirs of my deceased defendant. I reiterated that I have only asked for my half share in my prayer. Will the judge go beyond my prayer or will she consider my prayer of granting me my half share in the movable assets in succession? Will she also consider the 3 defendants and also give them half share?
