Asha Sharma and Rajiv Sharma were married in 2011 and have two minor children namely, Rohan and Anika. Due to repeated incidents of cruelty and neglect, Asha left the matrimonial home in January 2023 and began residing with her parents in Noida. She filed a petition for maintenance under Section 125 of the CrPC before the Family Court, Noida. After hearing both parties, the Family Court passed an Order dated 15.03.2024, directing Rajiv to pay ₹12,000/- per month to Asha, and ₹6,000/- per month each to Rohan and Anika from the date of the petition i.e. 01.02.2023. Rajiv is employed as an Assistant Manager in a private company in Delhi and draws a monthly salary of approximately ₹70,000/- Despite having sufficient income, he has paid only three instalments of maintenance (April, May, and June 2024) and has defaulted on all other payments. As of 01.01.2025, the total arrears of maintenance amount to ₹3,06,000/. Asha issued a legal notice to Rajiv on 10.02.2025, asking for payment of arrears, but Rajiv ignored the notice. The Order of the Family Court has neither been stayed nor challenged in any appellate forum. Asha now wishes to execute the maintenance order and recover the arrears of maintenance, along with continuing monthly maintenance. Draft an Execution Petition on behalf of the Decree Holder, Asha Sharma, seeking enforcement of the maintenance Order dated 15.03.2024 passed by the Family Court, Noida and recovery of arrears of maintenance from the Judgment-Debtor, Rajiv Sharma.

I borrowed ₹13 lakhs from an investor under a written agreement. Later, he gave another ₹17 lakhs without any agreement. Under threats, he forcibly took a ₹30 lakh cheque from me. I have already repaid ₹18 lakhs in total (₹16 lakhs directly and ₹2 lakhs extorted through his men who threatened my family). He is deliberately misusing the same cheque by repeatedly bouncing it and threatening to file cases, though he has not filed any case in 8 months. I have call recordings and messages proving threats, extortion, and coercion. When I approached the police earlier, he softened his stance and requested not to involve his father.I am 6 months pregnant with twins, under severe mental stress. Today he again contacted me asking for my home address, claiming he wants to send a legal notice and threatening media exposure. I fear continued harassment, extortion, and misuse of legal process. He sent a collection agent who threatened us and exorted money from us. After the police complaint, he stopped sending that man. But can it be used against him?

I am from Mumbai and landlord I had filed one case on my tenant of rent and eviction. The grounds are , arrears in rent, non uses and change of user. I had filed in 2023 and two years had passed case is going on but the tenant has still not paid me rent neither deposit court he is not willing to pay. Should I make application for recovery of rent in court??? My advocate adviced me not to make any application for rent as our case is on areas of rent and we had asked for eviction on that ground. If we make application for recovery of rent than our ground will became void . So please advice me what next step to do ??

In a partition deed Schedule A alloted to party-1 and schedule B to party-2 whereas schedule C was declared as joint property which is to be partitioned later equally but at the last page schedule C was strike off by party 1 before registration where as the contents remained as it was. After three decades same schedule C was acquired by national highways. During preparation of award sons of party 2 claimed to the sons of party 1 that their names should be also there in the award and the sons of party 1 didn't objected their names to be added in the award as they were not aware of the strike off in the partition deed as the original deed was in the custody of the sons of party 2. Also they filed writ petition for enhancement of compensation jointly.Later after disbursement of compensation in the joint account of party 1 and 2 somehow party 1 got the xerox of partition deed and found that strike off. Party 1 objected to the competent authority of land acquisition. After proper verification and Hearing proceeding competent authority recover back the compansation amount and paid entirely to party-1 sons. After that sons of party 2 filed writ in the high court. What will happen???

My defendant committed purgery in my succession case. I filed a purgery case which is a criminal case against her I have a prediction that she may not appear upon summoning after my preliminary evidence. She may give authority via GPA to another person to appear on her behalf. My advocate is somehow in favour of her and says let the GPA attend the court dates on my defendant's behalf and that my defendant will still be accused. Is this correct?
