Myself and my respondent were declared class 2 legal heirs by the court. My respondent died. I filed a succession case being the surviving class 2 legal heir. I made the 3 children of my deceased respondent a party to SUCCESSION case. In my petition I mentioned that they are the 3 children of my deceased respondent. In my prayer, in the succession case I only asked for my half share in movable assets. Now my case was in arguments stage. I argued that the 3 defendants/children of my deceased respondent never filed a claim or a counter claim or a separate suit, at the written statement/written reply stage. They never filed any proof of being the legal heirs of my deceased respondent up to the present times. The opposite councel came and argued that the 3 defendants are the children of my deceased defendant and that they should be given half the share in succession case, and that why should they file a claim. I argued that if I have made someone a party to my case, it does not mean that it is my "dava", or that I am offering them half the share of movable assets in succession case. And I also said that the 3 defendants have never filed any proof of them being legal heirs of my deceased respondent. I reiterated that I have only asked for my half share in my prayer. Will the judge go beyond my prayer or will she consider my prayer of granting me my half share in the movable assets in succession? Will she also consider the 3 defendants and also give them half share? The opposite councel gave a false statement in Court in written that it is my DAVA as a Petitioner that the 3 defendants also be given half the share, to which I filed my objection and stated that in my prayer I have only asked for my half share in succession. I never signed on any such Dava or false statement.

I filed a succession case in which I made the children of my deceased defendant a party. The children of my deceased defendant have never filed any document to prove that they are the legal heirs of my deceased defendant. In my SUCCESSION petition I mentioned that the 3 respondents are the legal heirs of my deceased defendant. I have only asked for my half share in succession as a relief in my prayer. I wish that my prayer be allowed and that the 3 respondents or the children of my deceased defendant should file a declaration case to prove themselves as legal heirs of their deceased mother.

मेरे पिता का एक जीआईसी बजाज एलायंज जनरल इंश्योरेंस 5 लाख का बीमा था और 50 हजार Lic का बीमा कराई गई 04/10/2006 को रेलवे दुर्घटना से मृत्यु सदर अस्पताल बिहार शरीफ में मृत्यु हो गई lic ने साधारण क्लेम भुगतान किया दुर्घटना क्लेम भुगतान किया गया 5लाख 6हजार रुपया उपभोक्ता फोरम नालंदा के आदेश पर 2013 में भुगतान कराई गई इस स्थिति में lic दुर्घटना क्लेम नहीं भुगतान किया गया है अतः इस संबंध में जानकारी दी जाय कि lic एक्सीडेंटल क्लेम भुगतान क्यों नहीं कर रही है।

So me and my brother in our village own a land of 5.8 Acer in our village but when we measure our both the lands we are not getting exact 5.8 Acer. I am getting less land of 8 guntas when we message and our brother is getting 1 Acer less when he measured so he is asking to give us the land from our registered land but we are opposing for it and pleasing them to check the missing land through lagel way that is we are advising them to check the whole survey number land and see weather the missing land is in other place but they are not listening to us so we thought of completing a police case in our town but some people are saying if you book a case on them the police authoritie will divide your both the land into half and close the case so if they do like that we will lose our more land so here I'm asking respected lawyer that is going to police is a good option or not
